Allocation of a state-owned flat or house

The application for the purchase of a flat or house should be submitted to the authority that manages the building where you live, and you will receive a purchase discount in accordance with the percentage of bodily disability

The application for the purchase of the flat or house you are using, i.e. the purchase with instalment payment under more affordable terms than market terms with regard to interest and repayment periods, should be submitted to the authority managing the said flat or house. It is also possible to submit the application to the Ministry of Croatian Veterans, after which the Ministry will ask the competent authority whether you are entitled to purchase the flat.

Purchase procedure

Based on your application, the bodies that manage the flat or house will submit to the Ministry of Croatian Veterans a list of persons and family members who are using the aforementioned flats and houses along with the submitted documentation. The Ministry of Croatian Veterans will decide on your application in a shortened procedure.

The bodies will hand over the flats and houses whose users have been established to have the right to housing to the Ministry with all the documentation, as well as the official records at their disposal, which are listed in the minutes of the handover.

Right of management and terms of purchase

The Government of the Republic of Croatia will adopt a decision on transferring to the Ministry the right to manage the flats and houses owned by the Republic of Croatia and managed by state administration bodies, which are not subject to the provisions of a special regulation on the sale of flats with attached tenancy right used by persons referred to in Article 83 of this of this Act.

The requirement is that these flats and houses are not subject to the provisions of the regulations on the sale of flats with attached tenancy right and that they are used by family members of a deceased or missing Croatian Homeland War veteran, disabled Croatian Homeland War veterans and members of the immediate family of a deceased disabled Croatian Homeland War veteran and Homeland War military volunteers who have not been granted the status of a disabled Croatian Homeland War veteran, but who participated in defending the sovereignty of the Republic of Croatia for at least two years in the combat sector.

Purchase agreement

The Ministry of Croatian Veterans is required to send an offer to the users of flats and houses for concluding an agreement on the purchase of a flat or house within one year, counting from the date of concluding the lease agreement. As users of flats and houses, you may purchase them if you make a one-time payment of the established price of the flat or house within six months from the date of the offer.

If after the expiration of the specified period you fail to make a one-time payment of the price of the flat or house, you may continue to use the flat or house as a protected tenant.

The facts crucial for the purchase of a flat or house are assessed at the time of concluding the purchase agreement.

Determining the discount

Family members of a deceased Croatian Homeland War veteran, family members of a missing Croatian veteran, disabled Croatian Homeland War veteran having group I-IV bodily disability and members of the immediate family of a deceased disabled Croatian Homeland War veteran having group I-IV bodily disability using a flat or house owned by the Republic of Croatia on the date the Act on Amendments to the Act on the Rights of Croatian Homeland War Veterans and their Family Members entered into force (17 December 2012) have the right to be allocated such a flat or house managed by state administration bodies and purchase it with 100 percent discount.
If you are a disabled Croatian Homeland War veteran having group V-X bodily disability or a member of the immediate family of a deceased disabled Croatian Homeland War veteran having group V-X bodily disability, and are using a flat or house managed by the aforementioned bodies (after 7 November 2001), have the right to be allocated such a flat or house and purchase it. The purchase discount depends on the percentage of bodily disability.

If you are a disabled Croatian Homeland War veteran having group V-X bodily disability or a member of the immediate family of a deceased disabled Croatian Homeland War veteran having group V-X bodily disability, and had been using a flat or house managed by the aforementioned bodies after 7 November 2001 up to the entry into force of the Act on Amendments to the Act on the Rights of Croatian Homeland War Veterans and their Family Members (17 December 2012), you are entitled to purchase the flat or house by being granted a housing loan.

Exceptionally, if you are a disabled Croatian Homeland War veteran having group V-X bodily disability or a member of the immediate family of a deceased disabled Croatian Homeland War veteran having group V-X bodily disability, and are using a flat or house owned by the Republic of Croatia and managed by the Agency for Transactions and Mediation in Immovable Properties, but transferred to be managed by the Ministry of Croatian Veterans, you have the right to be allocated such a flat or house and purchase it. The purchase discount depends on the percentage of bodily disability.

When purchasing a house, the user will be granted an additional discount in accordance with the percentage deviation of the existing family house from the standard building. The discount will be determined by the Expert Committee or another authorised person.

Purchase form a local self-government units

Members of the immediate and extended family of a deceased Croatian Homeland War veteran, members of the immediate and extended family of a missing Croatian Homeland War veteran and group I-X disabled Croatian Homeland War veterans and members of the immediate family of a deceased disabled Croatian Homeland War veteran with the same bodily disability who have been using flats and houses owned by local self-government units continuously for 5 years, may purchase them from local self-government units under the same terms and conditions as users of flats and houses managed by the aforementioned bodies.
