Personal assistance for persons with disabilities

Personal assistance is a social service that provides assistance and support to persons with disabilities in activities that they cannot perform on their own because of the type and degree of disability

Personal assistance is a social service that provides assistance and support to a person with disabilities in activities that he cannot perform alone because of the type and degree of disability, which he needs on a daily basis in the house and outside the house, as well as assistance and support in communicating and receiving information, in order to increase the degree of independence and involvement in the community, to protect and ensure the human rights of persons with disabilities, as well as to achieve equality with others.

A personal assistance service to a person with physical, intellectual or mental impairment is provided by a personal assistant, and the person can exercise the right to a service ranging from 44 to 352 hours per month.

The service of personal assistance to the person with hearing impairment and the deaf-blind person is provided by a communication mediator, and the person can exercise the right to a service in the range of 10 to 160 hours per month.

The service of personal assistance to the visually impaired person is provided by a visual escort, and the person can exercise the right to a service in the range of 10 to 60 hours per month.

The right to a personal assistance service provided by a personal assistant shall not be granted to a person:
  • who performs a home help service on the basis of a law governing the activity of social welfare or other Regulation
  • who is provided with accommodation in a social welfare institution and other social service providers, in a health or other institution, or organised housing under a law governing the activity of social welfare or other Regulation
  • whose parent or other family member has a recognised right to the status of parent caretaker or caretaker for the need to take care of him or her under the law governing the activity of social welfare, except in the case prescribed by Article 34 (4), (5) and (6) of this Act
  • who exercises the right to a carer under other regulations
  • held in an investigative prison or serving a prison sentence
  • who fulfils the personal assistance service that she provides by seeing companions
  • provides a home help service based on a law regulating the activity of social welfare or other Regulation
  • it is provided with accommodation in a social welfare institution and other social service providers, in a health or other institution, or in organised housing on the basis of a law governing the activity of social welfare or other Regulation.
The right to a personal assistance service provided by a seeing companion shall not be granted to a person:
  • provided with accommodation in a social welfare institution and other social service providers, in a health or other institution, or organised housing under a law governing the activity of social welfare or other Regulation
  • whose parent or other family member has a recognised right to the status of parent caretaker or caretaker for the need to take care of him or her under the law governing the activity of social welfare
  • who exercises the right to a carer under other regulations
  • to which a household member can provide companionship and assistance in day-to-day activities according to their needs
  • held in an investigative prison or serving a prison sentence
  • providing a personal assistance service provided by a personal assistant.

Exercise of rights

The potential beneficiary must submit an application to the competent regional office of the Croatian Social Labour Institute.

The Commission assesses the need for a personal assistance service and the number of hours of service based on the findings and opinions of the Office for expertise, Professional rehabilitation and Employment of persons with disabilities and other documentation for assessing the needs of users established at the regional office. The Commission shall, in cooperation with the potential beneficiary of the personal assistance service or its legal representative, draw up a list of user needs assessments. The Croatian Social Labour Institute decides on the right to a personal assistance service through a decision.
 

Suspension and termination of the right to a personal assistance service

A user who is in a health care institution and stays abroad for a continuous period of more than 30 days is determined by the decision to stay the right to a personal assistance service.

A beneficiary who is in a health institution and stays abroad for a continuous period of more than six months is determined by the decision to terminate the right to a personal assistance service.
