Rights of injured deminers, other employees in the mine action system and their family members

Injured employees in the mine action system and their family members exercise certain rights pursuant to the Mine Action Act

The Mine Action Act came into force on 21 October 2015.

Disability rights

Deminers who directly carry out tasks of additional general surveys, technical surveys, demining and quality control, quality control supervisors, worksite heads and assistants who directly carry out tasks of machine operators and dog handlers, as well as inspectors from the Ministry of the Interior who carry out tasks of inspection of technical survey worksites and/or demining worksites (hereinafter referred to as: persons from Article 107 of the Mine Action Act), have the following rights in case of injuries at work or occupational diseases resulting from them carrying out their tasks:
  • Right to healthcare 
  • Health insurance rights 
    • Right to a disability pension due to lost working capacity
    • Right to a disability pension due to reduced working capacity
    • Right to vocational rehabilitation due to reduced working capacity
    • Right to a survivor’s pension.
In case of a disability or disability which is a result of a wound or injury or exacerbation of a disease, persons from Article 107 of the Mine Action Act exercise the following rights:
  • Right to a personal disability allowance 
  • Right to an orthopaedic allowance 
  • Right to a special allowance 
  • Right to an allowance for care and assistance provided by another person 
  • Right to medical or physical rehabilitation.
The rights from this group are exercised pursuant to the regulations governing the rights of Croatian Homeland War veterans and their family members.

Rights of family members of fatally injured persons from Article 107 of the Mine Action Act and family members of injured persons with a 100 percent disability rating

Family members of fatally injured persons have a right to:
  • Family disability allowance 
  • Priority candidate status when applying for scholarships 
  • Priority of placement in student dorms 
  • Free textbooks 
  • Survivor’s pension, which right they exercise pursuant to the regulations governing the rights of Croatian Homeland War veterans and their family members. 
Family members of injured persons with a 100 percent disability rating have a right to:
  • Priority candidate status when applying for scholarships 
  • Priority of placement in student dorms 
  • Free textbooks. 

Mandatory insurances

Authorised legal persons and/or trade businesses and the Ministry of the Interior have to take out insurance for their employees from Article 107 of the Mine Action Act:
  • Insurance against death in the amount of at least 79.633,68 EUR
  • Insurance against work-related injuries in the amount of at least 106.178,25 EUR.

Only legal heirs of the persons from the mentioned Article of the Act can be the beneficiaries of this insurance.

Assistance for persons injured by explosive remnants of war

Persons injured by explosive remnants of war will be provided assistance appropriate to their sex and age, including medical treatment, rehabilitation and psychological support by means of cooperation of all public authorities and non-governmental organisations whose scope of work includes the issue of persons injured by explosive remnants of war.
 
Persons injured as civilians will be provided assistance in accordance with the regulations governing protection of servicepersons and civilians who are victims of war, while employees carrying out mine action tasks exercise their right to assistance in case of injuries in accordance with the provisions of the Mine Action Act.
